By accessing, browsing, or using the Humming Parrot website, mobile application, or purchasing any eSIM product or service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

2. Service Description

Humming Parrot Technologies Ltd. (“Humming Parrot,” “we,” “us,” or “our”) provides digital eSIM (embedded SIM) services for mobile data connectivity. Our services include:

Paid eSIM Data Plans: One-time purchase data packages for Caribbean islands and global destinations
Ad-Supported Free Data: Optional feature allowing users to earn limited data by viewing advertisements
eSIM Provisioning: Digital delivery of eSIM activation credentials (QR codes or manual activation codes)
Customer Support: Technical assistance for eSIM installation and troubleshooting

3. User Eligibility

To use our services, you must:

Be at least 18 years of age or have parental/guardian consent
Own or have authorized access to an eSIM-compatible device
Provide accurate and complete information during purchase
Have a valid payment method
Agree to use our services in compliance with applicable laws

4. Device Compatibility

You are responsible for ensuring your device supports eSIM technology before purchasing. Not all devices support eSIM, and carrier-locked devices may have restrictions. Check our Device Compatibility Guide before purchasing.

Humming Parrot is not responsible for purchases made for incompatible devices.

5. Pricing and Payment

All prices are displayed in the selected currency (USD, CAD, EUR, GBP) and include applicable taxes where required
Payment is processed securely through Stripe
Full payment is required before eSIM delivery
Prices are subject to change without prior notice (existing purchases are not affected)
Promotional codes are subject to their specific terms and conditions

6. eSIM Delivery and Activation

eSIM credentials are delivered electronically to your provided email address
Delivery is typically instant but may take up to 24 hours in rare cases
You are responsible for securely storing your QR code/activation details
eSIM plans begin counting down from the moment of first activation, not purchase
Lost QR codes can be re-sent by contacting support (verification required)

7. Data Usage and Fair Use Policy

Our services are subject to fair use guidelines:

Data plans are for personal, non-commercial use only
Excessive or abusive usage patterns may result in speed throttling or service suspension
Reselling or redistributing data services is strictly prohibited
Tethering/hotspot usage is permitted within your data allowance unless otherwise specified
VoIP calls, video streaming, and other applications are allowed within data limits

8. Network Coverage and Speed

Important: Network coverage and speeds are not guaranteed and depend on factors outside our control.

Coverage depends on local carrier infrastructure in each country/region
Speeds vary based on network congestion, location, device, and carrier conditions
4G/LTE/5G availability depends on local network capabilities
Remote areas, buildings, and certain locations may have limited or no coverage
Coverage maps are estimates and not guarantees of service availability

9. Third-Party Network Dependency

Humming Parrot acts as a reseller and technology platform. Our service relies on partnerships with:

Local mobile network operators (carriers) in each destination
eSIM provisioning technology providers
Payment processors (Stripe)

We are not responsible for service interruptions, outages, or issues caused by our third-party partners.

10. Prohibited Uses

You agree not to use our services for:

Any illegal activity or to facilitate illegal acts
Fraud, phishing, or other deceptive practices
Distribution of malware, spam, or harmful content
Unauthorized access to computer systems or networks
Harassment, abuse, or threats against any person
Circumventing usage limits or security measures
Commercial resale without authorization

11. Account Termination

We reserve the right to suspend or terminate service, without refund, if you violate these Terms of Service, engage in prohibited activities, or abuse our platform. We will attempt to notify you before termination unless immediate action is required.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Our liability is limited to the amount you paid for the affected service
We are not liable for indirect, incidental, special, consequential, or punitive damages
We are not responsible for loss of data, business interruption, or missed opportunities due to service issues
Services are provided "as is" without warranties of any kind, express or implied

13. Indemnification

You agree to indemnify and hold harmless Humming Parrot Technologies Ltd., its officers, directors, employees, and partners from any claims, damages, losses, or expenses arising from your use of our services or violation of these terms.

14. Governing Law

These Terms of Service are governed by the laws of Jamaica. Any disputes arising from these terms shall be resolved in the courts of Jamaica, unless otherwise required by your local consumer protection laws.
